Terms of Service

1. Agreement

EYP Ops is operated by EYP Labs, LLC (“EYP Labs,” “we,” “us”). By accessing or using EYP Ops (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not agree to these Terms, do not use the Service.

2. Service Description

EYP Ops is a cloud-based operations management platform for food service businesses. The Service includes purchasing, inventory, supplier management, cost reporting, and finance modules accessible via web browser and mobile-optimised interfaces.

3. Accounts

You must provide accurate, complete and current registration information. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect any unauthorised access.

Each subscription is tied to a single company tenant. Sharing credentials across unrelated entities is not permitted.

4. Payment

Paid plans are billed monthly or annually in USD unless a written agreement states otherwise. Subscriptions renew automatically unless cancelled before the next billing cycle. All fees are non-refundable except where required by applicable law, expressly stated in our Refund / Cancellation Policy, or expressly stated in a written agreement with EYP Labs.

Pricing is per outlet/location unless a written agreement states otherwise. Each restaurant branch is billed separately. Payment details are processed by our payment processor; EYP Labs does not store full payment card details. By providing payment details, you authorize us and our payment processor to charge the applicable subscription, setup, onboarding, implementation, tax and other agreed fees.

5. Data Ownership

You retain full ownership of all data you input into the Service (“Customer Data”). EYP Ops does not sell or share Customer Data with third parties for commercial purposes. We process Customer Data solely to provide and improve the Service as described in our Privacy Policy.

On subscription termination, you may export your data in CSV or JSON format within 30 days. After this period, we may delete Customer Data from active systems; anonymised or aggregated statistical data may be retained.

6. Acceptable Use

You agree not to:

• Use the Service for unlawful purposes or in violation of any applicable law.
• Attempt to reverse-engineer, decompile, or access the Service's source code.
• Transmit malicious code, spam, or content that infringes third-party rights.
• Resell or sublicence the Service without written permission from EYP Ops.

7. Termination

Either party may terminate the subscription at any time. EYP Ops may suspend or terminate access if you breach these Terms, with or without prior notice depending on the severity of the breach. Upon termination, your right to use the Service ceases immediately.

8. Limitation of Liability

To the maximum extent permitted by applicable law, EYP Labs shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service. Our total aggregate liability for any claim shall not exceed the amounts you paid to EYP Labs in the three months preceding the claim.

9. Governing Law

These Terms are governed by the laws applicable to EYP Labs, LLC, unless a separate written agreement states otherwise. Any disputes will be handled in the courts and venue specified in the applicable order form or master services agreement, or otherwise by the courts with jurisdiction over EYP Labs, LLC.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance of the updated Terms.
